Hi All...
My attorney filed my EAD (mailed) on August 28 this year and last Friday I saw the approval too on USCIS site. Today I decided to help one of my friends with his EAD so I decided to pull the attorney filed copy of my I-765, I noticed that attorney had mentioned "AOS" in Q:15 instead of H1B. I am on H1B and I have never used my EAD... so I am worried now and I don't know what are my options now... Would you please take few minutes of your precious time and help me with the options I may have now to correct this issue?

Once every check is completed it goes into a queue and then every month a list goes to an officer based on the priority date and visa availability
The best thing is to call them as soon as the processing dates go past your application date. Call them to find out about ur case. At that time they are open about ur case. They will let you know exactly if your name check is cleared.
They also mentioned that once everything is in place the files goes to the office and then it might take up to 90 days for the officer to make a decision.

Yes you have to fill out separate forms. I applied for my parents last october. One of them got it in 10 days and the other took more than a month. It is advisable to get the application in well ahead of your trip

The United States Immigration and Customs Enforcement (ICE) recently updated their list of Student and Exchange Visitor Program (SEVP) approved schools (http://www.ice.gov/doclib/sevis/pdf/ApprovedSchools.pdf). The schools listed have all been certified to participate in the program.
The program allows foreign students interested in obtaining an education in the United States to complete a visa petition, pay the required fee, and attend a U.S. College or University.
Interested Foreign students: There is a process in obtaining a student visa, but it is not a difficult one. The student must first obtain Form I-20 from the U.S. College or University from which he/she intends to enroll, pay the required visa fee (Form I-901) and contact a local U.S. Consulate/Embassy to schedule an interview. The SEVP procedures differ among U.S. Consulates/Embassies; contact your U.S. Consulate/Embassy NOW to determine its particular procedure on applying for a visa before planning for the interview.
Interested Schools: There is a separate process to obtain F & M Certification. Authorized school officials must obtain and complete Form I-17. An overview of the SEVP Certification process can be found on the ICE website . If approved, the school will be certified and allowed to issue Form I-20 to qualifying foreign students.

Do we need to file FATCA form (HIRE Foreign Account Tax Compliance: Reporting Requirements) also in addition to FBAR for Indian NRI accounts.

- For Perm and subsequently I-140, you can only specify employers that are directly relevant to the number of years of experience claimed in labor. The details of the petitioning employer are most relevant and all your past employments should add up to the experience required
- However, for I-485, which is your application, you have to specify all the employments that you filed taxes for and from whom you received your paystubs (primary/secondary).

I am thinking of leaving my current employer & joining the primary vendor for the client, wondering if my employer can hold back last month's salary OR how people have handled such situations.

Why should the employer hold your salary? If you had any agreement for paying back cost of your GC processing for leaving within a certain period, that would not hold any more (since last June such agreements are illegal)

I had a lot of emotional and financial distress upon my graduation and I didn't get to apply for OPT. What do I do?
I mean I know I need to go speak with the dept that handles intl students in my school?
But, like, any pointers or information to please assist me?
Any constructive information/help, will be useful!
Also, I am looking into getting into graduate school within the next yr to yr and half!
If you graduated 1 year ago and was no longer a student in this last year, and did not apply for OPT before graduation, then you are already out of status - your F1 status ceased when you graduated. Moreover, your I-94 most likely said D/S. So the I-94 covered your stay only during the time you maintained F1 status. So you have been accruing illegal presence time. 6 month of illegal presence would trigger 3 year ban on reentering US; and 1 year or more would trigger a 10 year ban.
The prudent thing for you to do is to go back to your home country, and come back with a proper VISA.

Yes he can apply for a TN again, no limit on the number of times alien can enter on TN. If he leaves while his COS is pending it will be considered to be abandonment of the petition.
