Its been pending at USCIS for atleast 6 months

Well I meet the first condition and visa numbers for my I-485 are available. But I dont meet the 2nd condition(not really sure). I for sure dont receive any benefits from SSA so I guess I cant use this settlement.
Any insights/ideas?

May I ask how you know this? Do you have some visibility to the internal processes, or have a credible source?

Once every check is completed it goes into a queue and then every month a list goes to an officer based on the priority date and visa availability
The best thing is to call them as soon as the processing dates go past your application date. Call them to find out about ur case. At that time they are open about ur case. They will let you know exactly if your name check is cleared.
They also mentioned that once everything is in place the files goes to the office and then it might take up to 90 days for the officer to make a decision.

Who would be better to handle a complex GC case Murthy or Rajiv's office.
Any experience? I am looking for somebody who is responsive and can handle difficult queries from USCIS, if need be. How much do they charge for complete EB case?

I hope you get some good suggestions- just a little thing- your attorney does not have to be located where you are, a lot of people deal long distance!

It's up to the employer if he wants to keep you as an employee and has the right to cancel your H1 if he likes to do so. Just because you left the country doesnt mean that your H1 becomes invalid, but again its up to the employer.

My wife has H4 stamped and valid till Nov 2008 but from Oct 2007 she changed her status to H1B. She has I797. My question is when she goes to India does she need to stamp H1 B or she can reenter on already stamped H4 ?

I am on H1B with a NJ consulting company since 10/2004.
I am working with a client in Los Angeles, CA.
My H1b Visa expired in 05/2010 and I just got my 3-year extention.
In my petition I gave details of current client.
Today an Agent came from USCIS for an onsite(client-side) visit and verification.
The agent asked me various question mostly related to my petition
I was told my name was picked up randomly.
It is part of USCIS Site visit and verification Program
Anyone has a similar experience?

My PERM for EB3 has been approved on July 2008. My I-140 is pending. 485 has not been submitted yet. I don't have EAD card either. For some reason, I have to change job.
My question is, if my current employer will not revoke my current I-140 sponsorship, even I have left company, and in case my current I-140 will be approved, can my priority date be carried over?

Well they could hurry up and approve my eb1-c that's been pending for 8 months despite them saying 4 is their target! I can't see how they can say not enough applications when they are way off their targets for poor souls like me. I've put in an SR so we'll see what happens

They will take your I-94 at the airport in washington where you will board your flight....
In my experience my previous I-94 was issued to me on AP for one year when I had come in......they did not bother with the I-94 on my H1B.
Anyways since yours is an international flight the agent at the counter will take care of whichever they want.....just present them with both. Mostly they do not bother with the one in I-797 notice.

I believe you know that re-entry permit is required only beyond 1 year.
I will say, don't wait. Have some documentation ready regarding your "emergency need" to be out of USA. Also have some documentation to prove your intention to permanently reside in US.
In case the officer asks some question. Just be prepared to answer, and clarify that you have proper intention to continue residing permanently in US.

I got my green card on Feb'2008 and had to make emergency travel to my country Mexico to be with my family on August'2008. Now, I would like to come back after 10 months of stay in Mexico. The problem is that I do not have any permanent residence/car/Electricity bill to prove my permanent residency status except VOIP phone and paid my tax for the last 6 years promptly. Is it possible for me to make it to USA? or Should I wait for 2 more moths and file for Visa reentry permit in local embassy and come there if I get one?
Please advice me.

not possible. Many documents in first 2 phases are companies. Its is illegal if employee is involved Labor process in any way.
Find someone who will file H1 for you next year and apply for GC....

I am planning to schedule a visa appointment soon. I was filling DS-156 form
and have a following question:
Item#36 : "Has anyone ever filed an immigrant visa petition on your Behalf?".
Here is my situation:

Myself -> H1B
My wife, kid -> H4
Applied for I-485 last year ( all 3 of us ).
Question:
For me, I understand that I say "yes" and mention name of my employer.
But for my wife+kid, I say "yes", but what should I fill for "who" part?
Also, Item#33 for my kid (2nd grade), should answer to "Do you intend to study
in US" be YES or NO ? ( my guess is YES, and name of the elementary school?)

Labor as such is not for a specific person (although you have to provide individual details for filing it), it is essentially for justifying a position within the company, so it's more company related than individual. Hence, USCIS allows transfers of labors as it is not bound to the individual for whom it was applied.

I am in NJ and my current H1b expires on Nov 2008. My DL expires on Set 2008 . I was under impression that I need atleast 6 months or more valid visa to get licence.
Company didnot agree to file premium process for H1b. They are saying I have plenty of time and they will apply in Aug . I and we know that now a days it takes more than 3-4 months to get visa.
Is there a way I can get temporary lic in Nj. lawer was saying I can request 3 month temp lic beased on Notice received from CIS. Is that true ? does any one gone through same in NJ ?

They visa officer provided a 221(g) administrative processing (pink) requesting additional documents (job description, reasearch projects, previous visas list etc..,). She is preparing the necessary docs to submit the same. Since she went to india for a short trip (travelling back next week).
1. She has Advanced parole. Can we use Advance parole??
2. If we use Advance parole, then once the Adminstrative processing is complete, how do we handle the stamping?? Do we need to go back again to the consulate to get the stamping done? or is there a way to withdraw the visa application from the consulate??

I have got my I 485 rejectd when i filed during AUG 2007 due to Improper fees but we paid the correct fees.We refiled with saying "Improper Denials of I-485 " and double packed saying byboss mail room. We tryied more than 5 times always we got back saying PD is not current. Please advice me how to proceed on this.
