GC Status: Filed in EB3, PD OCT 2004. I-485 not filed. I-140 status : Approved
Visa status: My LCA/H1visa end date is March 2011.
Situation:
I am on 7th year extension.H1 extension was approved based on approved I-140. H1 extension is set to expire in March 2011 (7-8 months)
There is a need for me to switch current employer.
1. Can the PD ported thru the next GC process by new employer, even if the I-140 is cancelled from prior employer ??
There is no fraud or any misrepresentation and if prior employer cancels appoved I-140.
Please provide insight in this case as how the USCIS officer takes decision on PD porting is concerned ?

I have an employee who was a student and then got employment authorization. She asked me to begin the process of getting her an H1B; but then we determined that she really wanted a green card. Can I use the LCA I got for her H1B to apply for her I-i40?

Hello All,
If my priority date is current as of November bulletin, do I have time
until 30th November to mail the I-485 application?
Or does the DOS need to have received the application on or before 30th November?
And if I am in California, where does the I-485 application physically go?
[Its a long story why I didn't when the doors were open in July-Aug]

First of all, I really appreciate your efforts to help people in their immigration issues.
Currently, I am on H4 visa. Recently, I was offered employment and got my H1B approved.
But, my new I797 approval notice does not contain I-94 part.
Do we need to apply for Change of Status from H4 to H1B now while I remain in US? Do I need to do it or my employer needs to do it?
I would really appreciate your help.

i have working on h1b with compant A. i got a job offer from company B ( a consulting company) for a third party client. i sent company B my H1b tranfer papers . i didn't signed any offer letter or agreement with company b till now. company B filed LCA for me and before they field for h1B transfer , i changed my mind and informed company B that i am not going to join them. now company B threatning me that they will sue me for the damages and fees they spent and put a stay on me so that i can not work for any other employer while the case is in court of law . i have all my personal and other information with them as i sent them all the documents for H1B transfer. there is no offer letter and agreement signed between us and it was only verbal communication apart from some E mail exchanges and documents sent for transfer of visa. any body please advice does company B can create any problems or file any suit againt me . what are my rights ? i am still working for company A and don't want to get into any trouble..

In G-325, there is one column for "Applicant's residence last five years".
For me, I have not submitted my current address by filing AR-11 form. This G-325 is asking my present address plus last addresses. So what should I do? Do I need to send them AR-11 form too?
You are thinking too much. Just give them past addresses. Do not make it complicate. They are just asking for record purposes. They may verify with credit bureaus if they want to investigate further.

Last week i received RFE for my wife's father's name. The name on birth certificate is different from school leaving & other docs. I'm trying to get it corrected from Mumbai.
I beleive if i get a correct one matching with other docs, i should be ok.
Another issue, i have is i have rented an apartment under my name close to my work in the same state. All my docs have my home address, my question is will it affect my case if they find another address under my name?? I still have official address as my home everywhere...
Yes you need to make sure that all documents have consistency in names and dates. As far as your second question goes USCIS has space for just one address which should be your current address. So as long as you can prove that the address listed in CIS system is the most current address then you are fine. There is no law or no way to provide multiple address. Just make sure you can prove that address on file is your primary residence.

A startup in the area filed for my PERM and it was approved in June 2010. Right now, they are in a mess about their tax returns and reauditing with their CPA and it seems that they will not be able to provide tax statements for this year end.
That will cause the PERM to expire without filing I140 since PERM expires in Dec. Is there anyway for us to file extension for the PERM ? More than 180 days...
I think they should still be able to file your I-140 in regular processing by not including the latest tax papers (include previous years). Since it takes a few months to process I-140 under regular filing, they will likely issue an RFE asking for tax documents. Hopefully, by then they are done with their audit and would be able to reply to the RFE with tax documents or provide explanation on why they cannot provide the requested documents but they can provide any other document that proves their ability to pay. That way, you won't lose your approved PERM.

No wonder these antis cannot find jobs. Who will employ people who lack intelligence to know that we H1Bs pay taxes. They need to go and find other better arguments against us.
