What I don't understand is why you are filing another I-140 when you already filed I-485? In any case you can use AC21 only after your 485 has been pending for more than 180 days.
Employer A with EB3 PD Feb2003 and I 485 filed
Same Employer A is doing EB2 PERM with I 140 PD porting
Is it possible to invoke AC21 in middle of process??
1. is it possible to use AC21 after 140 approval??, any time constraints?
2. what about between 140 filing and 140 approval?
3. at what stage it is not safe?
any advice please

My Personal experience was:
- When my H1B was filed for the first time it had a wrong Date of Birth, lawyer asked me to bring Birth Certificate to the Interview at the consulate. I did not have problems with the stamping of the visa.
When my extension was filed , again, Date of Birth was wrong. Lawyer told me the same thing. Get recent Birth Certificate and bring it to the Interview.
Did not have any problem at all.

You could try to reopen the case with Supporting evidence of ill health and age. This is a long shot, but a good attroney should be able to pose a compelling argument. Also, try to get an infopass appointment and talk to someone about your options.

Can spouse leave to home country after filing concurrent i140 and 485 application?
Her and mine application (concurrent 140 and 485) was filed on July 2nd, 2007but I have not received RECEIPT # yet. Can my spouse leave USA or we have to have get Receipt # first ?

Hi,
I need suggestion on travel.
I have applied AP for my wife on April 16 and still waiting. We have expiated her AP last week, still no updates. She has an emergency travel on June 20th. Her previous AP is valid till June 24th.
Can she travel out side on June 20th and come back with new AP when approved (I can mail her the new one once approved) or dose she needs to be in US until the new AP is approved?
As the old AP is valid till June 24th, dost it mean that they will approve the new one only after June 24th?
As this is an emergency I need your suggestion please...

Were your collegues EB-2 classification with old PDs from the DoL's backlog centres?
I see some of the EB-2 indian nationals with old PDs received approvals so that USCIS can process their I-485.
If you are EB-3 then you might want to wait until Dec 2007.

Gentlemen,
I had a quick question with EAD I understand that I can switch job after 180 days as long as there is 50% match in job description. However my companiy's legal coordiantor send me a weird query that she cannot find the job in hard to fill category. So my question is Does the job I am applying for using my EAD has to be hard to fill as in case of H1 or the only requirement is that the job description should match 50% with the underlying LC.

I think the processing time for I-485 at NSC is complete BS. Its hard to believe that they have pre-adjudicated all the employment based applications received in July-Aug'07.
