    I don't think that would work. Here are a couple of articles that seem to suggest that you cannot create your company on H-1B (http://www.laborimmigration.com/2008/01/starting-own-company-on-h-1b-visa/) and also that you cannot volunteer to do a job which would otherwise by a paying job (http://www.laborimmigration.com/2008/02/unpaid-volunteer-work-on-h-1b-h-4-or-f-1-visas/)

    Hope that helps.

    As a H1B holder, can I start a new company and volunteer for it while I am holding a full-time job for the company that sponsors me the visa? I am expecting the new company to gain a profit, of course.:)

    My wife is primary applicant for 485. We both are continuing on H1 and have EADs. Our Son came as my dependent.

    Our company is brought by another company and countdown has started for our group. Looking at present market conditions I may have to use EAD. Will try to transfer H1 but just in case ...

    Guys,

    I would appreciate if you could help on this.

    I last entered in US using AP and currently working on EAD . My H1 is going to expire in April 2010. I am thinking of renewing it to provide a backup in case anything happens to my 485. I have to go to India in July 2010 and I would like to come back using AP. Pleass let me know which of the following option is best for me.

    1. Renew my H1 now and go to India n July and come back using AP.I understand that in this case, if I have to use H1, I would have to go to India and get it stamped.

    2. Come back from India in July and renew my H1 after I come back. Is this possible to renew the H1 after it expires and do they give you a I94 in this case?


    Please let me know what you think. I need to decide ASAP.

    Hi,
    company A did H1B and H4 (both approval notices. No Visas stamped yet)
    company B is doing H1b only. Can the dependent candidate stay on company A's sponsored H4 approval ?

    No need to file H4 till her current H4 expires. As long as you are maintaining continuous H1 status (without gaps), H4 would remain active till its current validity even if primary H1 applicant changes jobs. You can file her H4 extension of stay petition 90 days in advance from the current H4 expiration date.

    Hi,

    Have a question on EAD/H1b. I am joining a new company using AC21 and EAD. Lets say after few months if INS denies my GC application then will I be able to transfer my h1b. Basically I got the info that I can re-capture my unused period of H1b out of 6 years. Is that true ?

    I am applying for my AP and EAD renewal, please help me with few questions:

    For EAD:
    14) Manner of last entry: H4? (I was on H4 when I last entered)
    15) Current Immigration Status: AOS? (My husband received his GC)
    16) Eligibility: ???
    17) Eligibility: None?

    For AP:
    1.3) Class of Admission: H4?
    3.2) Expected length of time: ???

    Last time, my husband's company attorney had filed our papers. Since, my husband received his GC, we have to renew ourselves. Should I send a form to cancel G28? Thanks in advance to all for their time and advise.

    I applied for my first labor in 2004 Feb, due to backlog center processing and I140 RFE so I applied for second labor from same employer in 2006 Sept.
    Second labor and I140 cleared with out any problem, mean while during in 2007 July I applied I485 based on my second labor.
    Later after six months my first I140 was cleared.

    My question to IV Guru's, Is there any process to interfile older priority date to the second
    labor. I mean is there any process to restore priority date of first labor to second one. As my I485 application is based on second labor.

    Any suggestions are appreciated.

    We need a handle to kick start a similar plead. In the last one year and quarter here at this forum, I had never seen one that CIS has done injustice to us by mis-interpreting a rule or law or act. If somebody knows otherwise, please state and cite facts. The class action suit ("Schneider vs. Chertoff") was filed by Shusterman on behalf of a group of international doctors in response to CIS regulations implementing the Nursing Relief for Disadvantaged Areas Act of 1999. Section five of the Act provides that "any alien physician" can qualify for a green card through a "National Interest Waiver," provided they practice in a federally designated health professional shortage area. The National Interest Waiver program is intended to accelerate the hiring of international doctors willing to serve in such areas.

    In its regulations implementing the Act, the CIS stated that only primary care physicians, not medical specialists such as surgeons or radiologists, could qualify for green cards through a National Interest Waiver. The agency's regulations therefore eliminated the right thousands of international specialist physicians had to petition for green cards through the National Interest Waiver program.

    Your H1B is tied to your current company. If your new employer wants to hire you, they have to file a separate H1B for you.

    So your answer should be. "I need H1B sponsorship to work."

    Dates are valid as of November 30, 2008. Texas is processing July 11, 2007 applications. Looks good. It means CIS finally has time to work on the deluge of applications they received in July 2007, even though the dates are not current yet. The approvals may still be far off, but at least we know that our apps are being worked upon.
