My employer filled EB-2 PERM for me on 12/2007.
My I-140 is approved on 07/2008.
Now I am worry about losing my job.
If this happens, maybe I will switch to NIW pathway later.
Now I wonder whether NIW can use the PD of PERM?
My attorney is not sure about this.
Anyone here succeed in this?

Nebraska Service Center mailed I-131 approval notices for me and my wife on 28th Oct. But we never received them. Its been a month now. So, I called USCIS today morning and they say I need to reapply for I-131 for my whole family because some one else might have picked it up.
I called up post office. They say they have no mails on hold.
Is reapplying the only way out?
This happened with me with Texas service center. They insisted they had sent it. But in reality they never sent it. I was told the same "You need to apply for a fresh one. That is the only way out of it." I was determined not to pay fees a second time for no fault of mine.

If you have e-mails that's good enough. No need to be scared, if you feel that you have not done anything illegal there is nothing to be afraid of. If your prev. employer starts to threaten in any way play it smart and try and get him to write e-mails, you can use that against him. Always consult a lawyer first to discuss the pro's and cons.

I came to US on H4. My H1B got approved when i was in India. But I came through H4 only.
Now i want to change H4 to H1B. If i want to apply for change of status..do i need to go back to india(ot other countries) for stamping? Or can i get H1B staying here?

Currently you are on H4. If you apply for H4 to H1 transfer, you can get H1 and start working from October this year. If you cannot find project immediately, you wait up to 3 months or 6 month (maximum), otherwise change status back to H4 or you will be in trouble. Since economy is not good, it is tough to get projects nowadays, already current H1 holders are looking for projects and some have gone back. if you have already worked in India, then you may get project easily, If you did not work, then it is tough to get a project. When you are on H4, you can have peaceful life while your psouse is working, you can have get togethers whenever you want, you can cook special dishes for your spouse and wait at the door in the evenings.Real problem arises when you become pregnant (assuming you are woman), you need to take a long break if you are working,, especially if you are away from your spouse....so point is have fun with spouse, have get togethers with other couples, go shopping at BedBathandBeyond/walmart/target/jcpenny in discount seasons, have honeymoon trips again n again...Go to India whenever you want.These things are so memorable than struggling to get projects and maintaining status. When you cant maintain status you cannot go to India whenever you want....

Not true. There is no limit, except that eventually US immigration may decide that the person has relinquished their permanent residence if they stay outside the US for many years.

To where you sent your 485 package. I recommend to utilize services of Attorney - primarily because they attach their cover letter with their letterhead which could make some difference

I was in a similar situation as you and had to use this firm. H1B filing experience was fine but the entire GC process and filing was not a good experience at all. There were days I had to call the paralegal and teach him the new immigration laws and that's never a good sign ! Because of their mistake I was stuck in Eb3 rather being in Eb2. May be they will deal differently with your case but have a chat with them and your company managers before you agree to use them. I m with another company and another attorney firm and they are awesome !

Hi, I applied for my green card (NY state) and have my priority date as 09/25/2003. I see the status as Pending on the backlog elimination center website. I have still not received any updates from them. My lawyers said they are still waiting to hear back from the BEC. Have they started processing Sep 2003 applications at this point?

I'm on OPT right now ,i'm done with my masters in DEC 2007.
My visa Stamp in my passport was only untill april 2008(I got F1 stamped only for 24 months), now i'm on OPT extension.I applied H1B in 2008 and got RFE my employer could not answer the RFE and revoked my petition.
I did't apply in 2009 even i have chance to apply(because of the JOB fear ) i got my OPT extension approved ,my OPT extension is going to end in June 2010 , any way i will be applying H1B in 2010.
My question is if i don't get H1B in 2010 ,my plan i to take CPT and search for jobs ,does it effects my future immigration any way.

I was looking through my LC and 140 documents and found out that there are two different job titles in LC. One is Employer Job title which is "Analyst Programmer" other one is prevailing wages occupational title which is "Computer Systems Analyst". My question is what should be my Title at new employer?
