But since your I-140 is filed, you should upgrade it to PREMIUM and try to get it approved asap.
Worst case scenario - if company B is not considered successor in interest to company A, you can still use the approved I-140 to carry over your PD.

You are paroled into US until Dec 05, 2009. But if you want to travel outside US after July 29, you better apply for AP now.

when we go for finger printing will they ask for the A#. If so, do we need to provide the one with the 0 that is on the FP notice or the one with out the 0 (this is on the 485 receipt)

Hi,
My H1-B got Accepted but I didnt recieved my I-94. I completed my masters here. There are no status issues. My OPT will expire on Dec 27.
I applied for H1-B amendment under Premium processing but i got query of Company documents and 2004, 2005 paystubs.
My employer answered them that employee is not there in the usa in those years. Below is the response from USCIS
Current Status: Response to request for evidence received, and case processing has resumed.
On October 09, 2008, we received your response to our request for evidence. We will notify you by mail when we make a decision or if we need something from you. If you move while this case is pending, call customer service. You should expect to receive a written decision or written update within 60 days of the date we received your response unless fingerprint processing or an interview are standard parts of case processing and have not yet been completed, in which case you can use our processing dates to estimate when this case will be done. This case is at our CALIFORNIA SERVICE CENTER location. Follow the link below to check processing dates. You can also receive automatic e-mail updates as we process your case. I dont think that holds true. If you follow you'll see they have been approving cases even in December for 2003 when the PD has been retrogressed to 2002 for December.
The actural allocation of a visa # hapens after your 485 is approved. After he approves your case, the adjudicating officer will send the case to someone else to allocate the visa # for you. This will take days. That will explain what you've metioned here. Those cases were acturally approved in Nov. I bet you wouldn't see any more such case by late or even mid Dec.

I guess we should ask them to remove the employer's restriction, which is the prime reason for extreme exploitation. H1b should not be restricitive. IV should also address the same. We are looking at the current problem with retrogression only, but what about future aspirants who come on H1.
H1B quota and H1B related issues are not primary concern of this organization. Greencard retrogression is. It has been that way since the inception 18 months ago.
We have taken positions to make H1B more workable and have less restrictions on it regarding H1 extensions and H1 transfers and therby opposed major portions of Durbin-Grassley.
HOwever, right now is not the time to debate and have open discussion on flaws of H1B program.
This is distraction at minimum and ammo for anti-groups in worst case scenario. Please contribute, send webfaxes, make phones and provide live updates and save this discussion on H1B flaws for slower times.

My I-140 was filed on Aug 25 (India -Regular) and I haven't received the receipt number yet? Is this normal for paper filing. What is my best option here to expedite the process?

For FP, USCIS takes the address from G325A or from the I485 form. The reason I am asking is because my company is putting their's address in I485. So I am wondering.

I have a valid AP approved on Oct 13, 2007. The H1B visa stamped on my passport expired in Mar 2007. I have a valid one year H1B approval till Mar 2008. I do not have the original I797 approval notice but have a scanned copy of it. Now if I have to travel out of country in July and enter back on AP will there be any trouble at the POE with not having the original approval notice of last H1B.
Any inputs will be appreciated. Thanks

Hi, I am currently on my 5th year H-1B visa. I have an option to stay with the same firm and they will help me apply greencard. But I am also considering an opportunity in Bermuda for a 2-3 year program (with the same firm).
My question is if I come back to the US after 2 years, will I be able to apply H-1B visa again? Will it be a whole new H-1B petition/application process subject to the H-1B cap?
Or will it be just another H-1B renewal process following my previous two terms?
Do I need to wait for another two terms of H-1B to expire before starting the greencard process?
Can I ask my currently employer to apply for greencard concurrently while I am working outside the US?
